Four Universiti Kebangsaan Malaysia (UKM) students have applied for an injunction to delay disciplinary proceedings against them for allegedly campaigning during the recent Hulu Selangor by-election.
One of the applicants, Muhammad Hilman Idham (left in photo), said an injunction was sought on the grounds that it would allow them time to challenge the constitutionality of Section 15 (5A) of the University and University Colleges Act (UUCA).
"We have written a letter to the university last Thursday, giving them until 12.30 today to reply to our request for the the disciplinary hearing to be delayed until our challenge to the UUCA is decided."But since the university has not replied to us, we are filing the injunction to allow us some time," he explained.The application for the injunction was filed at the Shah Alam High Court this afternoon by lawyer Ashok Kandiah.Kandiah explained that the student's summons questioned the constitutionality of Section 15 (5A) vis-à-vis Article 10 of the Federal Constitution, which outlines fundamental freedoms such as freedom of speech, freedom of assembly and freedom of association.
Currently, the High Court is scheduled to hear the case at 9am Wednesday, but Kandiah is trying to push for a hearing tomorrow.
Arrested in Hulu Selangor
Other than Muhammad Hilman, the other students are Muhammad Ismail Aminuddin, Azlin Shafina Mohamad Adzha and Woon King Chai. All four are second-year political science students.They were notified on May 13 that they have to face a disciplinary hearing for contravening Section 15 (5) of the UUCA.Muhammad Hilman and Azlin Shafina were arrested at Pekan Rasa on April 22, allegedly for possessing CDs and literature which "expressed support or sympathies" to certain political party contesting in the by-election.Muhammad Ismail was arrested in Ampang Pecah on the same day in a van which contained political leaflets. The circumstances of Woon's arrest are unknown.The four have urged the university to drop charges against them and have sought intervention from the Malaysian Human Rights Commission (Suhakam).They claim that their presence at the campaign was part of a field trip, to observe the subject of their study first hand.
