Witness: Handcuffs worn by Kugan not found

The Petaling Jaya Sessions Court was told that the handcuffs placed on A Kugan's wrists throughout the police interrogation could not be found after the detainee was reported dead at the police station in January last year.ASP Mohd Marzuki Mohd Mokhtar, 32, said he too did not know where the key to the handcuff was and confirmed that he had no further knowledge on the matter.


"If I don't know about the handcuffs, how could I know about the key to the handcuffs," he said when cross-examined by defence counsel PM Nagarajan, who is defending Constable V Navindran who is being charged for causing serious injury to Kugan.The reaction of the witness when replying to his question had irked Nagarajan who reminded Mohd Marzuki that there would be other questions if he did not reply according to his questions.The 22nd prosecution witness told the court that he also did not know whose handcuffs were being used on Kugan when the incident occurred.Mohd Marzuki was testifying at the trial of Navindran, 28, who pleaded not guilty on Oct 1 last year to two counts of causing grievous injury to Kugan, 23, a suspect in the thefts of luxury cars.Navindran was accused of committing the offence at the interrogation room of the D9 office, at Taipan Police Station, USJ, Subang Jaya at 7am on Jan 16, last year and charged under Section 331 of the Penal Code which carries a jail term of up to 10 years and a fine upon conviction.For the two alternative charges of causing injury to Kugan, Navindran also pleaded not guilty to the charges at the same place and time under Section 330 of the Penal Code which carries a jail term of up to seven years and a fine upon conviction.In his testimony on April 7, the 19th prosecution witness, Constable Mohd Fauzi Mohd Nor, 29, said that the handcuffs used on Kugan belonged to him as he was working from Jan 15 until the next day at 8pm.The hearing before Judge Aslam Zainuddin continues on July 19 where two more prosecution witnesses would be called. The witnesses are the assistant investigation officer of the case, Insp Khairi Kamarudin and chemist Adriane Reeza Ali, from the Chemistry Department.
